CAN-SPAM Act

The CAN-SPAM Act (Controlling the Assault of Non-Solicited Pornography And Marketing Act) is a US federal law enacted in 2003 that sets rules for commercial email messages. It requires accurate header information, clear identification as an ad, a physical address, and a working opt-out mechanism.

Key Requirements

  • Don't use deceptive headers - From, To, and routing information must be accurate
  • Don't use misleading subject lines - Subject must reflect the email content
  • Identify as an ad - Commercial emails must be clearly identified as advertisements
  • Include your address - Must include a valid physical postal address
  • Honor opt-outs - Must process unsubscribe requests within 10 business days
  • Monitor third parties - You're liable for emails sent on your behalf
